随着时代的进步，农业科学技术的发展日新月异。育种作为农业科学技术中重要的组成部分，也成为了农业发展战略的主题之一。我国虽然植物新品种发展时间还不长，但是这些年育种行业取得了蓬勃的发展。这些显著的成绩都离不开植物品种权保护制度的日益完善。由于我国植物品种权保护起步晚，因此，在植物品种权保护方面还存在着许多不足之处。实际中最明显的表现是农业植物新品种权转让中的纠纷问题层出不穷，转让过程受阻，导致植物品种权流动转化不畅，植物新品种无法得到快速有效的推广应用，进而阻碍了农业发展的脚步。因此，发现我国植物品种权保护制度中存在的不足，找到相应的有效的对策，完善植物品种权保护制度具有重要的意义和必要性。 　　　本文的内容主要由以下五个部分组成： 　　　第一部分是引言，主要介绍本文研究的背景、研究目的、研究意义和研究方法，概述研究内容，梳理本文的研究思路，并形成技术路线图，概括本文拟解决的关键问题，找出本文可能的创新和不足之处。 　　　第二部分是本文的理论基础和文献综述，理论基础部分清楚地介绍了植物新品种权、植物品种权保护、植物品种权转让相关内容。文献综述部分对截至目前的有关植物品种权保护的文献研究等文字材料进行总结和归纳，了解目前该领域的研究现状，并试图从中找出本文研究的理论依据和价值。 　　　第三部分是植物新品种权转让方式及存在问题，该章节主要阐述了转让的方式及植物品种权保护存在的一些问题。 　　　第四部分是案例分析部分，本文选取了玉米杂交种D品种和S品种的品种权转让案例进行分析。首先对案例内容进行简介，然后对案例进行具体分析，并解释植物品种权保护在植物品种权转让中的重要作用，总结目前植物品种权保护的现状。 第五部分是植物新品种权转让中植物品种权保护的对策，首先概括总结国外相关的植物品种权保护的经验，主要参考借鉴的是美国、欧盟以及日本三个植物品种权保护制度比较完善的国家，然后提出适合我国国情的具有针对性的参考对策和建议

The agricultural science and technology is rapidly developing by times. Breeding, the important part of agricultural science and technology, is one of themes of agricultural development strategy. Although the development of new plant varieties has not been so long, it has achieved rapid development in these years. All the achievements should be owned to the improvement of the plant variety protection system. Because of the late start of plant variety protection in our country, there are still a lot of inadequacies. Actually, there are endless disputes in the transfer of agricultural plant varieties. The transfer process is blocked, which results in poor flow transformation of plant variety rights, new varieties of plants cannot be quickly and effectively promoted the application, thereby impeding the pace of agricultural development. Therefore, it’s meaningful and essential to find out the shortcomings in our plant variety protection system and the relative effective countermeasures to improve the protection system. 　　　This paper is mainly composed of the following five parts: 　　　The first part is introduction. It concludes the background, purpose, significance and research methods. It overviews the research content, combs the ideas of the research, and formats the technology roadmap. It also summarizes the key problems to be solved, find out the probable innovation and inadequacies in this paper. 　　　The second part is the theoretical basis and literature review. The theoretical basis detailed introduces new variety of plants, the protection of plant variety rights and the transfer of plant variety rights. Literature review summarizes the existing studies about the protection of plant variety rights to comprehend the status quo of this field and discover the value of this study. 　　　The third part is the case analysis. The paper selects the case of the variety rights transfer of corn hybrid D and S. Firstly, it introduces the case content, and then analyze the case. It also explains the role of the protection of plant variety rights played in the transfer of variety rights, and summarizes the current status of the plant variety protection. 　　　The fourth part analyzes the inadequacies and the problems existing in the plant variety protection. 　　　The last part summarizes the successful experience of protection system of the U.S., European Union and Japan. Then, it presented with specific countermeasures and suggestion suitable for our national conditions.
