随着经济以及科学和技术的发展,我国金融改革的深化,我国消费金融结构不断升级,消费金融公司迅猛发展,担任着越来越多的重要的角色。我国消费金融公司在推动国家经济增长和居民消费层面取得了巨大帮助作用,但与其他发展较为成熟的金融领域行业相比仍有不足,尤其是在监管方面。2020年新冠疫情影响,整个金融行业整体增速缓慢,促使加强科技化转型。同时互联网贷款的强监管,各项利好消费金融公司的政策陆续出台,消费金融公司牌照审批加速,大型电商、互联网机构纷纷入局,再加上居民消费能力、消费需求升级等因素,消费金融业在鼓励发展消费金融的同时,采取了一系列措施平衡创新和风险,遏制盲目扩张和滥用杠杆风险。2021年2月银保监会指出消费金融公司等四类非银机构治理水平有待增强。 为了落实国家对于消费金融公司的监管政策,积极防范国家金融体系风险,本文以南京市地方消费金融监管为案例展开研究,通过分析南京消费金融当前的监管情况和民众对消费金融的反馈来为当前南京金融监管机构提供相关对策建议,帮助其充分发挥监管职能,实现源头风险把控,进而保障地方消费金融行业稳定有序的开展业务,这也正是本文选题意义之所在。 本文以公共选择和公共利益、协作性公共管理理论为基础,结合文献资料和问卷调查,阐述了消费金融公司在中国的发展情况,结合当前消费金融公司处罚案件的客观分析,发现南京地区政府的监督监管机制不完善,监管政策实施不到位,监管边界不清楚,缺乏辅助监督四个方面的问题,并针对四个方面来分析监管不足的原因。与此同时,作者通过文献研究,对美国、日本和欧盟国家监管模式进行分析比较,结合中国目前的消费金融行业调控政策,总结了消金公司现有的条件,希望能够借鉴国外发达国家的先进经验,改善自己的缺点。最后,针对南京地区消费金融公司在政府监管方面存在的问题,提出了一些建议:进一步完善法律法规,贯彻监管政策的执行,加强监管协作联动,构建完美的行业监管机构。希望通过这一系列的措施,在我国构建稳定、协作、共享的金融监管体系,建立第三方监督管理机构,合理分配中央与地方、地方与地方各部门的金融监管权等,从而真正做到提高政府监管效率,保证政府监管质量,确保消费金融公司有序稳定健康发展,从而推进经济持续稳定发展。 |

With the development of economy, science and technology, the deepening of China's financial reform, China's consumer finance structure is constantly upgrading, the rapid development of consumer finance companies, playing a more and more important role.China's consumer finance companies have achieved a great role in promoting national economic growth and household consumption, but there are still insufficient compared with other mature financial industries, especially in supervision.With the impact of COVID-19 in 2020, the overall growth rate of the whole financial industry was slow, promoting the strengthening of scientific and technological transformation.At the same time, the strong supervision of Internet loans, the favorable consumer finance companies, consumer finance companies license approval, large electricity, Internet institutions have entered, coupled with residents consumption ability, consumption demand upgrade, consumer finance in encouraging the development of consumer finance at the same time, took a series of measures to balance innovation and risk, curb blind expansion and abuse of leverage risk.In February 2021, the China Banking and Insurance Regulatory Commission pointed out that the governance level of four types of non-banking institutions, such as consumer finance companies, needs to be enhanced. In order to implement the national regulatory policy for consumer finance companies, actively prevent national financial system risk, this article to nanjing local consumer finance supervision as a case study, through the analysis of nanjing consumer finance and public feedback on consumer finance to provide relevant countermeasures for the current nanjing financial regulators, to give full play to the regulatory function, realize source risk control, and then ensure the local consumer finance industry stable and orderly business, this is the significance of this topic. Based on the public choice and public interest, collaborative public management theory, combined with literature and questionnaire, expounds the development of consumer finance companies in China, combined with the objective analysis of consumer finance company punishment cases, found that the supervision mechanism of Nanjing regional government is not perfect, supervision policy implementation is not in place, regulatory boundary is not clear, lack of auxiliary supervision, and to analyze the reasons of insufficient supervision for four aspects.At the same time, the author analyzed and compared the regulatory mode of the United States, Japan and the EU through literature research, combined with China's current consumer finance industry regulation policies, summarized the existing conditions of the consumer finance company, hoping to learn from the advanced experience of foreign developed countries and improve their own shortcomings.Finally, in view of the problems existing in the government supervision of consumer finance companies in Nanjing, we put forward some suggestions: further improve laws and regulations, implement the implementation of regulatory policies, strengthen the coordination of supervision, and build a perfect industry regulatory agency.Hope through this series of measures, in China to build stable, cooperation, sharing of financial supervision system, establish a third party supervision and management agencies, reasonable distribution of central and local, local and local departments of financial supervision, so as to truly improve the efficiency of government supervision, ensure the quality of government supervision, to ensure the orderly, stable and healthy development of consumer financial companies, so as to promote sustainable and stable economic development. |
